Terms of Service for CoachPointe

These Terms of Service ("Terms") govern your access to and use of the CoachPointe mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility and Accounts

• You must be at least 13 years of age to create an account without parental involvement.
• If you are under 13, a parent or legal guardian must create and manage the account and provide verifiable parental consent through our payment process.
• Parents and legal guardians are responsible for all activity that occurs under a child's account. CoachPointe provides tools to help parents supervise their child's use of the Service. Because AI-generated recommendations are automated, parents and instructors should ensure that exercises match the child's individual physical readiness and environment.

2. Subscriptions and Payments

• CoachPointe offers both a limited free tier and paid subscription plans.
• All payments are processed through Google Play Billing or Apple In-App Purchase, depending on your device.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• We will provide at least 30 days' notice before any price increase takes effect.
• You may cancel your subscription at any time through your app store account settings. Refunds are governed by the policies of Google or Apple.

3. License and Intellectual Property

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. All content, software, AI-generated plans, and feedback remain the property of CoachPointe or its licensors.

Certain features of the Service may reference well-known professional dancers and their publicly performed choreography or technique solely for purposes of educational comparison and analysis. Such references do not imply any affiliation, endorsement, sponsorship, or commercial relationship with any referenced dancer or their affiliated organizations. CoachPointe does not use, reproduce, or mimic the likeness, image, voice, or persona of any professional dancer. By using the Service, you acknowledge and agree that these references are made for educational purposes only.

4. User Content and License Grant

You retain ownership of any voice notes or other content you upload. By uploading content, you grant CoachPointe a limited license to use that content solely to provide and operate the Service. We will not use children's voice recordings or movement data to train or improve our AI models without separate, explicit consent.

5. Acceptable Use

You agree not to misuse the Service. Prohibited activities include violating any law, attempting to reverse engineer the Service, uploading harmful content, or sharing account credentials.

6. Physical Activity and Medical Disclaimer

Important: CoachPointe is an educational tool designed to provide movement analysis and ballet technique feedback. It is not a substitute for professional in-person ballet instruction, coaching, or medical advice.

Ballet and physical training carry inherent risks of injury. By using the Service and following any AI-generated training plans or feedback, you acknowledge and accept all risks associated with physical activity. You should consult a qualified ballet instructor and, when appropriate, a physician before beginning or modifying any training program. CoachPointe assumes no liability for any injury or loss resulting from the use of the Service.

7. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind.

To the maximum extent permitted by law, CoachPointe's total liability arising out of or relating to these Terms or the Service shall not exceed the greater of:

• The total amount you paid to CoachPointe in the twelve (12) months preceding the claim, or
• One hundred dollars ($100) for users on the free tier.

In no event shall CoachPointe be liable for indirect, incidental, special, consequential, or punitive damages.

You acknowledge that these Terms are between you and CoachPointe only, and not with Apple, Inc. or Google LLC. Neither Apple nor Google has any obligation to furnish maintenance or support services for the App.

8. Termination

We may suspend or terminate your account if you violate these Terms. For non-urgent violations, we will generally provide at least 7 days' notice before termination. Upon termination or account deletion, your access to the Service will end, and we will delete or de-identify your personal data in accordance with our Privacy Policy (subject to legal retention requirements). Any active subscription will be canceled according to the policies of Google Play or Apple.

9. Dispute Resolution

Informal Resolution: Before initiating any formal proceeding, you agree to first contact us at dancedad.studio@gmail.com and attempt to resolve the dispute informally for at least 30 days.

Arbitration: If the dispute is not resolved informally, any claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by American Arbitration Association (AAA) in accordance with its applicable rules. The arbitration shall take place in Portland, Oregon.

Class Action Waiver: You agree to resolve disputes on an individual basis. You waive any right to participate in a class action or other representative proceeding.

COPPA Carve-Out: Nothing in this Section 9 limits any rights you may have under COPPA or other applicable children's privacy laws.

Application to Child Accounts: For accounts created on behalf of a child, the dispute resolution provisions in this Section apply to the parent or guardian who accepted these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles.

11. Changes to These Terms

We may update these Terms from time to time. We will provide notice of material changes through the App or by email. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
